Trademark Registration Process in India

The process involves several steps, each crucial to securing your brand identity:

1. Trademark Search

Before filing, conduct a search to ensure your desired mark isn’t already registered or too similar to existing ones. This helps avoid objections or rejections later.

2. Choose the Right Class

Trademarks are categorized into 45 classes—Classes 1–34 for goods and 35–45 for services. You must file under the correct class(es) based on your business activities.

3. Filing the Application

You can file online at Trademark Registry office. 

4. Examination

After submission, the application is examined by a Trademark Officer. If there are no objections, it proceeds to publication. If objections arise, you’ll need to respond or attend a hearing.

5. Publication in Trademark Journal

If accepted, the mark is published in the Trademark Journal for 4 months. During this time, third parties can oppose the registration.

6. Opposition (if any)

If an opposition is filed, both parties are heard. If the opposition is dismissed, the application proceeds. If upheld, the application is rejected.

7. Registration

If no opposition is filed or if it’s resolved in your favor, the trademark is registered, and a Registration Certificate is issued. You can now use the ® symbol.

8. Renewal

A trademark is valid for 10 years and can be renewed indefinitely every 10 years using Form TM-R.
